IMK has received the legal arguments of the MIDI in the group judicial review cases. The arguments are fairly lengthy, but in essence they simply defend the right of the MIDI to hold interviews to ensure that applicants have an advanced intermediate level of ability in French. They also defend the position that a person whose demonstrated ability at interview was two levels or more below level 7 misrepresented their ability on their application. In my opinion, what the law requires is presentation of one of the credentials identified as representing advanced intermediate ability in French, not a demonstration of a particular level at an interview, is not addressed. In addition, I do not believe that a case was made out to support a reasonable believe that applicants who had properly obtained a pass in a French course had perpetrated a misrepresentation. Ultimately, it is a judge of the Quebec Superior Court who will make the decision as to which argument is right. The date should be set for the hearing soon and we will be sure to let all of you know when that will happen.
